DIFC wills and UAE inheritance: the decisions to make before drafting

What happens without a registered Will

The estate does not move automatically. The family may need a court-led inheritance process to establish the heirs or appoint an estate representative before banks, land authorities and other asset holders recognise who can act. The applicable law depends on the person, the asset type, its location and any valid Will.

A bank may restrict account privileges or funds after receiving evidence of death, and property transfers or sales normally require inheritance and registration steps. There is no universal eight-to-sixteen-month timetable. Equally, a Will does not guarantee completion in one or two months.

What the Will should settle

• Which assets and jurisdictions fall within its scope.
• Who receives shares of the estate or named gifts.
• Who acts as executor and who can act as a substitute.
• Whether eligible minor children need interim and permanent guardian nominations.

Assets that may be relevant

Depending on the Will type, the plan may address UAE real estate, bank or brokerage accounts, company shareholdings, personal property and eligible digital assets. A drafted Full Will may also refer to assets outside the UAE, but foreign enforcement depends on the law of each country and is not guaranteed.

DIFC and UAE civil Wills are different routes

DIFC Courts provides six specialist Will types for eligible non-Muslims and supports electronic registration with two eligible witnesses. The federal UAE civil-Will framework uses the competent court and can address the whole estate or part of it. Language, document format, remote availability and fees depend on the chosen authority. A registered civil Will can be revoked or replaced; it is not correct to say that it can never be changed. Compare the routes in detail.

Who benefits from a tailored review

• Owners of completed or off-plan UAE property.
• Families with minor children, previous relationships or children from different relationships.
• People with more than one nationality or assets in more than one country.
• Business owners, investors and holders of digital assets.

A Will is not a Power of Attorney

A Power of Attorney generally authorises another person to act during the principal’s lifetime and is subject to its terms and applicable law. A Will takes effect after death. Asset owners often need to review both documents, but one does not replace the other.

Registration does not eliminate probate

After death, the nominated executor still applies for the relevant Grant of Probate and follows the estate-administration process. Debts, expenses, documents, asset-holder requirements and any dispute can affect timing. Avoid fixed promises such as “one or two months.”

Prepare a simple first list

Start with family members, intended beneficiaries, possible executors and guardians, asset categories and countries. Once the Will route is agreed, the relevant supporting information may include:

• The testator's valid passport and Emirates ID, if applicable, plus valid photo ID for two eligible witnesses.
• Property Will: title deed or Oqood certificate; Business Owners Will: share certificate or other ownership proof.
• Financial Assets Will: bank or broker name, account reference and type, Emirate and ownership share; statements are optional.
• Signed Guardianship Statements where guardianship provisions apply.

Never send passwords, seed phrases, private keys or complete bank or wallet credentials. Passport copies for beneficiaries and executors are not universally mandatory and should be supplied only when requested through an appropriate channel.

Review the Will when life changes

A registered DIFC Courts Will can be modified through the applicable process. The current DIFC service fee is AED 550 per Will, with professional fees separate; the replacement Will supersedes the earlier one. Review it after marriage, divorce, births, deaths, major asset changes, new company ownership, relocation or changes to another Will in a different country.
